ARTICLE 1. DEFINITION AND SCOPE OF "GUARANTEED BEST PRICE
1.1 Conditions of application of the "Best Price Guaranteed
The “Best Price Guaranteed” applies if the following cumulative conditions are met:
- you have booked a room (on its own or with breakfast included) in one of the appart hotels eligible for the “Best Price Guaranteed” (see the list of eligible appart hotels in article 2 below), directly via a Nemea Appart Hotel channel (websites, telephone or directly with the residence),
- a confirmation number has been issued to validate this booking.
- and within 24 hours of confirmation of your booking sent by e-mail or confirmation of your booking by telephone, and no later than 48 hours before the expected date of arrival at the appart hotel residence:
o you find, for the same appart hotel residence, for the same date(s), the same length of stay, under the same pricing conditions (i.e. refundable or non-refundable, advance payment and deposit requirements, room only or with breakfast included, booking cancellation and modification conditions), the same room type (identical category, size, bedding, view or location) and the same number of people in the room,
o a room offered at a lower public price and available for booking, this price being calculated in the same way, on the same basis of the total amount of the stay with the same inclusions (taxes, VAT, services),
o on the website, the mobile site or application (“Third Party Booking Channel”)
(hereinafter the “Eligible Reservation”).
“In the event of an Eligible Reservation, validated by Nemea Appart Hotel under the conditions provided herein, Nemea Appart Hotel will apply the Third Party Booking Channel price and offer you an additional discount on the Third Party Booking Channel price on the total amount of the accommodation booked up to 10%.”
For example:
- if the rate booked as part of an Eligible Reservation on the Nemea Appart Hotel channel is 200 euros,
- and the rate found on the Third Party Reservation Channel is 180 euros,
- then the final rate applied by Nemea Appart Hotel in application of the “Best Price Guaranteed” will be 162 euros (180 - 10%).
1.2 Exclusions from the Best Price Guarantee
The “Best Price Guaranteed” does not apply in the following cases:
- Group rates (greater than 5 rooms)
- Corporate rates,
- Special promotional offers giving rise to an additional discount after booking confirmation (such as promotional codes provided after subscribing to a newsletter),
- Member rate or subscription programs offered on the Reservation Channel of a relevant third party,
- Rates offered by opaque inventory sales sources (i.-. i.e. Hotwire and Priceline) that specify the aparthotel's name or location only after confirmation of the reservation,
- Rates displayed on websites/portals/webpages without an online reservation system, such as news sites or sites that confirm reservations only after contacting the aparthotel (“reservation request”);
- Rates that are part of a package that includes both a room and an airline ticket, a cruise, a car rental or any other activity or service inside or outside the appart hotel residence. Best Price Guaranteed" does not apply to websites requiring membership, online memberships or password/log-in programs to view aparthotel rates and room availability.
ARTICLE 2. RESIDENCES COVERED BY THE “BEST PRICE GUARANTEED” SCHEME
The apartment hotels covered by the “Best Price Guaranteed” are the Nemea Group's apartment hotels in mainland France.
ARTICLE 3. CURRENCY AND PRICE DIFFERENCES
If the rate of a third party reservation channel is indicated in a currency different from that of the Eligible Reservation :
- Nemea Appart Hotel customer service will convert this rate into the currency of the Eligible Reservation; the exchange rate used will be the exchange rate applicable via Nemea Appart Hotel channels at the time the Eligible Reservation was made;
- the “Best Price Guaranteed” will be applicable if the rate of the Third Party Reservation Channel is at least five percent (5%) or 5 euros lower than the amount of the Eligible Reservation, it being specified that the greater amount between the two will be retained.
For example :
- if the rate booked as part of an Eligible Reservation on the Nemea Appart Hotel channel is 200 euros,
o the actual rate must be at least 5 euros lower: 195 euros,
o OR the rate must be at least five percent (5%) lower: 190 euros.
- if the rate observed on the third-party reservation channel is 192 euros, then the “Best Price Guaranteed” will apply.
- if the rate observed on the third-party reservation channel is 197 euros, then the “Best Price Guaranteed” will not apply.
Price differences due to fluctuations or differences in currency exchange rates will not be taken into account in the context of the “Best Price Guaranteed”.
ARTICLE 4. PROCEDURE FOR BENEFITING FROM THE “GUARANTEED BEST PRICE” OFFER
4.1 Application form
To benefit from the “Best Price Guaranteed” you must (i) fulfil the conditions mentioned in article 1 above and (ii) complete the application form.
The mandatory fields (as specified in the application form) indicated on the application form must be correctly completed. In this respect, you warrant that the information provided in the application form is true and complete. Nemea Appart Hotel cannot be held responsible if errors or incomplete information have been provided by the Customer and if, as a result, Nemea Appart Hotel is unable to apply the “Best Price Guaranteed” under the conditions set out herein.
4.2 Screenshots
The application form must be accompanied by a screenshot displaying both the date of capture and the lowest price found via the Third Party Booking Channel and the associated terms and conditions of sale, as well as any other documents in support of the application. Applications that are incomplete or incorrect, or that include ineligible or incomplete documents, will not be processed. The screenshot must clearly show the date of stay, the name of the appart hotel, the sales conditions, the number of people in the room and the prices offered on the third-party reservation channel.
Requests must be submitted within 24 hours of confirmation of the Eligible Reservation and no later than 48 hours before the scheduled arrival at the appart hotel residence. To meet these deadlines, you must refer to the times and dates mentioned in your reservation confirmation e-mail.
ARTICLE 5. REQUEST MANAGEMENT
After verification by Nemea Appart Hotel customer service, you may benefit from the “Best Price Guaranteed” if your request complies with all the conditions mentioned herein. Nemea Appart Hotel customer service will send you an e-mail, no later than one week after the complaint has been sent, to the e-mail address entered in the form, with the confirmation number of the Eligible Reservation and the new applicable rate.
If the request does not comply with the “Best Price Guaranteed” conditions, Nemea Appart Hotel customer service will send you an e-mail stating that you cannot benefit from the “Best Price Guaranteed” and giving the reasons for this refusal.
Should you wish to cancel the Eligible Reservation and not benefit from the “Best Price Guaranteed”, please refer to the cancellation conditions applicable to your Eligible Reservation, which are detailed in the Eligible Reservation confirmation e-mail.
ARTICLE 6. PAYMENT TO THE APPART HOTEL ON DEPARTURE
In the event of an Eligible Reservation, and in the absence of advance payment, the rate confirmed by Nemea Appart Hotel customer service under the conditions set out in the previous article will be invoiced by the appart hotel residence on departure, together with all other services not included in the reservation (restaurant, bar, etc.).
If the Eligible Reservation has been prepaid at the time of online booking, the refund will be made to the same credit card.
Services not included in the reservation (restaurant, bar, etc.) will be invoiced by the appart hotel residence upon departure.
ARTICLE 7. LIABILITY
Insofar as Nemea Appart Hotel has no control over any Third Party Booking Channel, Nemea Appart Hotel disclaims all liability for any expenses that may arise as a result of the cancellation of a booking, for all bookings made via any Third Party Booking Channel.
ARTICLE 8. AMENDMENTS TO THESE TERMS AND CONDITIONS
Nemea Appart Hotel reserves the right to modify these terms and conditions at any time. The modified terms and conditions will take effect on the date they are posted on the site and are applicable to all requests made on the site from that date.
Nemea Appart Hotel invites the Customer to read these terms and conditions carefully before each request, as they may have been modified. Any request implies prior consultation and acceptance of these terms and conditions by means of a checkbox provided for this purpose and including a hypertext link to these terms and conditions.
Nemea Appart Hotel also reserves the right to terminate the “Best Price Guaranteed”, at any time, it being specified that requests submitted prior to the termination of the “Best Price Guaranteed” will be processed by Nemea Appart Hotel under the conditions set out herein.
